1. Acceptance of These Terms

These Terms and Conditions (“Terms”) govern your access to and use of redlighttherapy.com, including all content, features, newsletters, and related pages (together, the “Site”). The Site is operated by its owner and operator, referred to in these Terms as “RedLightTherapy.com,” “we,” “us,” or “our.”

By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, do not use the Site.

These Terms are a legally binding agreement between you and us. Please read them carefully. Section 13 contains a jury trial waiver and a class action waiver.

2. Eligibility

You must be at least 18 years old to use the Site. By using the Site, you represent that you are 18 or older and have the legal capacity to enter into these Terms. The Site is directed to users in the United States. We make no representation that the Site or its content is appropriate or available for use in other locations, and you are responsible for compliance with local laws if you access the Site from outside the United States.

3. Nature of the Site; Affiliate Disclosure

The Site is an informational and review publication about red light therapy and related products. We do not manufacture, sell, ship, service, or warrant any product featured on the Site.

Compensation from brands. We may also receive compensation from brands whose products appear on the Site, including sponsored placements, display advertising, and free or discounted products provided for review. Effect on content. Compensation and commercial relationships may influence which products we cover and where or how they appear, including in rankings, comparisons, and “best of” lists. They do not change the price you pay. Where a specific piece of content is sponsored or involves a material connection to a featured brand, we disclose it in that content.

4. No Medical or Professional Advice; No Medical Devices Sold

Not medical advice. The Site provides general information for educational purposes only. Nothing on the Site is medical advice, and nothing on the Site creates a physician-patient or other professional relationship between you and us or any contributor. Do not use the Site to diagnose, treat, cure, or prevent any disease or condition, or as a substitute for the advice of a licensed healthcare provider.

Talk to your doctor. Consult a physician before beginning red light therapy or any other treatment, especially if you are pregnant or nursing, take photosensitizing medication, have a history of skin cancer or eye disease, have an implanted medical device, or have any other medical condition. Never disregard or delay professional medical advice because of something you read on the Site. If you believe you have a medical emergency, call 911 immediately.

No medical devices sold; no regulatory representations. We do not sell medical devices or any other products. Products discussed on the Site are designed, manufactured, marketed, and sold by third parties. Any statement about a product’s FDA clearance, registration, intended use, safety, or effectiveness originates with the manufacturer or seller, and we do not independently verify it. We make no representation that any product is safe, effective, or appropriate for you or for any particular purpose.

Results vary. Testimonials, before-and-after images, reported outcomes, and summaries of published research describe individual experiences or study populations and are not a promise of your results.

No other professional advice. Nothing on the Site is legal, financial, tax, or other professional advice.

5. Accuracy of Information; No Guarantees

We work to keep the Site accurate and current, but we do not guarantee that any content is complete, accurate, reliable, or up to date. Product specifications, prices, availability, promotions, and coupon codes change frequently and are controlled by third parties; confirm them with the retailer before you buy.

Reviews, ratings, and rankings are the opinions of our writers at the time of publication. They may be based on hands-on testing, manufacturer-provided information, published research, or user feedback, and they may not reflect later product changes. We may modify, correct, or remove any content at any time without notice.

6. Third-Party Products, Links, and Retailers

The Site links to third-party websites, retailers, and products that we do not own or control. We are not responsible for their content, policies, pricing, shipping, returns, warranties, product safety, recalls, or data practices. When you leave the Site, the third party’s terms and privacy policy govern your activity.

Any purchase you make through a link on the Site is a transaction solely between you and the third-party seller. Direct all questions about orders, payment, delivery, returns, defects, warranties, or recalls to the seller or manufacturer. We are not a party to those transactions and have no obligation to you in connection with them.

The Site and all of its content, including text, reviews, rankings, graphics, logos, photographs, videos, page layouts, data compilations, and software, are owned by us or our licensors and are protected by United States and international copyright, trademark, and other intellectual property laws. “RedLightTherapy.com” and the Site’s logos are our trademarks or trade names and may not be used without our written permission.

We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Site for your personal, non-commercial use. You may not copy, reproduce, republish, scrape, frame, mirror, distribute, sell, license, or create derivative works from any part of the Site, or use any of its content for commercial purposes, without our prior written permission. All rights not expressly granted are reserved.

Third-party trademarks, product names, and logos appearing on the Site belong to their respective owners. Their appearance does not imply that those owners endorse, sponsor, or are affiliated with the Site.

8. User Conduct

You agree not to, and not to help or encourage anyone else to:

  • Use the Site for any unlawful purpose or in violation of these Terms;
  • Access, scrape, crawl, index, or copy the Site or its content by automated means, including bots, spiders, scrapers, and data-mining tools, or bypass any robots.txt directive or technical restriction;
  • Use the Site’s content to train, fine-tune, evaluate, or develop any machine-learning or artificial-intelligence model or dataset;
  • Reverse engineer, decompile, or attempt to access non-public areas, servers, or systems of the Site;
  • Upload or transmit viruses, malware, or other harmful code, or interfere with or disrupt the Site’s operation, security, or infrastructure;
  • Impersonate any person or entity, or misrepresent your identity or affiliation;
  • Post or transmit content that is false, defamatory, obscene, harassing, threatening, infringing, or that violates any person’s privacy or other rights;
  • Advertise, solicit, or send unsolicited commercial messages through the Site without our permission;
  • Manipulate affiliate links, cookies, referral codes, or tracking mechanisms, including through cookie stuffing, click fraud, or unauthorized coupon or link redistribution, or otherwise interfere with our relationships with advertisers, retailers, or affiliate networks; or
  • Remove, obscure, or alter any copyright, trademark, or other proprietary notice on the Site.

We may investigate suspected violations, remove content, restrict access, and cooperate with law enforcement and affected third parties.

9. User Submissions

If you submit comments, reviews, questions, testimonials, photos, or other material to the Site or to us by email, form, or social media (“Submissions”), you grant us a perpetual, irrevocable, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, edit, adapt, publish, translate, and display those Submissions in any medium, with or without attribution. You represent that you own or control all rights in your Submissions and that they do not violate any law or any third party’s rights.

We may review, edit, refuse, or remove Submissions at any time without notice, but we have no obligation to monitor them. Submissions reflect the views of their authors, not ours, and we are not responsible for them. Do not include personal health information or other sensitive information you do not want made public.

Any unsolicited ideas, suggestions, or feedback you send us may be used by us for any purpose without compensation or obligation to you.

10. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED, SECURE, OR ERROR-FREE OPERATION.

WE MAKE NO WARRANTY OR REPRESENTATION ABOUT ANY THIRD-PARTY PRODUCT, RETAILER, OR WEBSITE, INCLUDING ANY PRODUCT’S SAFETY, QUALITY, EFFECTIVENESS, OR REGULATORY STATUS, OR ANY RESULT YOU MAY OBTAIN FROM USING IT. YOUR USE OF THE SITE AND YOUR RELIANCE ON ITS CONTENT ARE AT YOUR OWN RISK.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR OWNERS, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, CONTRIBUTORS, AFFILIATES, LICENSORS, SUCCESSORS, AND ASSIGNS (TOGETHER, THE “RELEASED PARTIES”) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, OR FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE, ARISING OUT OF OR RELATED TO THE SITE, ITS CONTENT, ANY THIRD-PARTY PRODUCT OR WEBSITE, OR THESE TERMS, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL THE RELEASED PARTIES’ TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS EXCEED ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In those jurisdictions, our liability is limited to the fullest extent permitted by law. The limitations in this Section are a fundamental basis of the bargain between you and us and apply even if any limited remedy fails of its essential purpose.

12. Indemnification

You agree to defend, indemnify, and hold harmless the Released Parties from and against all claims, demands, damages, losses, liabilities, judgments, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your access to or use of the Site; (b) your Submissions; (c) your violation of these Terms; or (d) your violation of any law or the rights of any third party. We may assume the exclusive defense and control of any matter subject to indemnification by you, at your expense, and you agree to cooperate with our defense of that matter.

13. Governing Law; Venue; Jury Trial and Class Action Waiver

Governing law. These Terms and any dispute arising out of or related to the Site or these Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules, and by applicable federal law of the United States.

Venue. You agree that any dispute, claim, or controversy arising out of or related to the Site or these Terms will be brought exclusively in the state courts located in Broward County, Florida, or in the United States District Court for the Southern District of Florida, and you consent to the personal jurisdiction of and venue in those courts. We may seek injunctive or other equitable relief in any court of competent jurisdiction to protect the Site or our intellectual property.

Informal resolution first. Before filing any claim, you agree to send us a written description of the dispute at the contact address in Section 19 and to attempt in good faith to resolve it informally for at least thirty (30) days.

JURY TRIAL WAIVER. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND WE EACH KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY PROCEEDING ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS.

CLASS ACTION WAIVER. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE TO BRING CLAIMS AGAINST US ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

14. Termination

We may suspend, restrict, or terminate your access to all or part of the Site at any time, with or without notice, for any reason, including a suspected violation of these Terms. Any provision that by its nature should survive termination will survive, including Sections 3 through 13 and 16 through 18.

15. Changes to These Terms

We may revise these Terms at any time by posting the updated version on the Site and changing the “Last updated” date above. Changes take effect when posted. Your continued use of the Site after a change is posted means you accept the revised Terms. Please review this page periodically.

16. Privacy; Electronic Communications

Our Privacy Policy explains how we collect, use, and share information, including through cookies, analytics, and affiliate tracking. By using the Site, you consent to the practices described there.

By using the Site or subscribing to our emails, you consent to receive communications from us electronically and agree that any notice, disclosure, agreement, or other communication we provide electronically satisfies any legal requirement that it be in writing. You may unsubscribe from marketing emails at any time using the link in each message.

17. Copyright Complaints (DMCA)

If you believe content on the Site infringes your copyright, send a written notice to our designated copyright agent at [hello@redlighttherapy.com] that includes: (a) your physical or electronic signature; (b) identification of the copyrighted work you claim is infringed; (c) identification of the allegedly infringing material and its location on the Site; (d) your name, address, telephone number, and email address; (e) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and (f) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf. We may remove or disable access to material we determine to be infringing and may terminate the access of repeat infringers.

18. General Provisions

Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Site and supersede all prior or contemporaneous understandings.

Severability. If any provision of these Terms is held invalid or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force.

No waiver. Our failure to enforce any provision is not a waiver of that provision or of our right to enforce it later.

Assignment. You may not assign or transfer these Terms or any rights under them. We may assign these Terms without restriction, including to a successor, affiliate, or purchaser of the Site.

Third-party beneficiaries. The Released Parties are intended third-party beneficiaries of Sections 10 through 12. Otherwise, these Terms confer no rights on any third party.

Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control.

Headings. Headings are for convenience only and do not affect interpretation.
